1. Introduction and definitions
These Terms of Service (the "Terms") govern your access to and use of the OnlineJTI platform. By using the Service, you enter into a legally binding agreement with Optimas Organisasjonspsykologi AS.
In these Terms the following words have the meanings set out below:
- "Optimas", "we", "us" and "our" mean Optimas Organisasjonspsykologi AS, a Norwegian limited company (org. no. [[NO_ORG_NUMBER]]) with its registered office at [[REGISTERED_ADDRESS]].
- "Service" means the OnlineJTI platform at onlinejti.com, including the assessment engine, reports, AI-assisted features, course content and related applications.
- "Practitioner" means a certified professional authorised to administer the JTI assessment, invite Respondents and generate Reports.
- "Respondent" means an individual invited by a Practitioner to complete the JTI assessment.
- "JTI" or "Assessment" means the 56-item Jungian Type Index personality questionnaire.
- "Report" means any output generated from the Assessment, including the personal report, team report and AI-generated insights.
- "Distributor" means an authorised partner that operates its own tenant of the Service (for example Optimas, CFL, Decision).
2. Acceptance and changes
By creating an account, accepting an invitation to take an Assessment, or otherwise using the Service, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy.
We may update these Terms from time to time. When we make material changes we update the version reference shown at the top of this page and prompt you to re-accept inside the application before your next use of the Service. The continued use of the Service after re-acceptance constitutes acceptance of the updated Terms.
If you do not agree to the Terms, you must stop using the Service.
3. Eligibility
You must be at least 16 years old to use the Service. If you are under 16, you may use the Service only with the verifiable consent of a parent or legal guardian provided through your Practitioner's organisation, and only where local law permits.
Practitioner accounts are reserved for individuals who hold a valid JTI certification recognised by Optimas or an authorised Distributor. Your right to administer Assessments is conditional on your certification remaining in force.
4. Accounts and security
You are responsible for the accuracy of the information you provide and for keeping your account credentials confidential. You must not share your password or allow another person to use your account.
You must:
- use a strong, unique password and enable two-factor authentication where offered;
- notify us without delay at security@onlinejti.com if you suspect any unauthorised access to your account;
- keep your contact details up to date so that we can reach you with security and service notices.
You are responsible for all activity that occurs under your account, except where the activity results from our breach of these Terms or our security obligations.
5. Practitioner-specific terms
These provisions apply in addition to the general Terms when you use the Service as a Practitioner.
Licence to administer
Subject to your continuing certification and these Terms, we grant you a non-exclusive, non-transferable licence to administer the JTI Assessment, manage Respondents, and generate Reports for your clients.
Your role under data protection law
When you invite a Respondent and process their assessment data, you (or the organisation you represent) act as the data controller for that Respondent's personal data. We act as a data processor on your instructions. A standard Data Processing Agreement is available on request from privacy@onlinejti.com.
Before inviting a Respondent you must inform them of the purpose of the Assessment, who will receive the Report, and the lawful basis on which their data is processed, in line with Articles 13 and 14 of the GDPR.
Credits, invitations and balance
Practitioner accounts use a credit-based balance to issue Assessment invitations. Each Assessment that is started against an invitation consumes one credit. Unused credits remain available until your account is closed.
Your account may be linked to a company-level balance shared with other Practitioners in your organisation. You are responsible for monitoring your own usage.
6. Respondent-specific terms
These provisions apply when you use the Service as a Respondent.
You are not charged for taking the Assessment. Your Practitioner's organisation is responsible for the cost.
Your participation in the Assessment is voluntary. You may stop the Assessment at any time, and you may withdraw at a later date by contacting your Practitioner or by using the data deletion controls in your account.
Your individual Report is released by your Practitioner. Your Practitioner controls when and how the Report is shared with you and, where applicable, with your team.
7. Permitted use of Reports
JTI Reports describe psychological preferences and tendencies, not fixed traits or abilities. They are intended for personal development, coaching, communication and team collaboration.
Reports must not be used as the sole or principal basis for:
- hiring, promotion, demotion, redundancy or other employment decisions;
- clinical diagnosis or mental-health treatment decisions;
- security clearance, vetting or selection processes;
- legal, financial or medical advice.
Practitioners are responsible for ensuring that their use of Reports complies with applicable equality, employment and data-protection law.
8. AI-assisted features
Parts of the Service use third-party large language model providers to generate text for type insights, team analysis, and the course coach. The AI providers we use today are Anthropic (Claude), OpenAI and Groq.
AI-generated text is produced by statistical models and may contain mistakes, omissions or outdated information. It is not a substitute for professional judgement. Reports and insights produced by AI must be reviewed by a qualified Practitioner before they are relied upon for any consequential decision.
We do not use AI to make automated decisions that produce legal effects on you or that significantly affect you within the meaning of Article 22 of the GDPR.
We process AI-related data under signed Data Processing Agreements with each provider, including Standard Contractual Clauses for transfers outside the European Economic Area, and we instruct providers not to retain inputs or use them to train their models. 9. Acceptable use
You agree not to:
- use the Service in violation of any applicable law or regulation;
- reverse engineer, decompile or attempt to extract the source code of the Service or the JTI methodology;
- scrape, copy or republish substantial parts of the Service or its content without our written consent;
- resell, sublicense or commercially exploit access to the Service except as expressly permitted by your Practitioner agreement;
- upload content that is unlawful, defamatory, infringing, harassing or that contains malicious code;
- interfere with the security or integrity of the Service, including by overwhelming it with traffic;
- use the Service to process special-category personal data (as defined in Article 9 of the GDPR) outside the scope of the Assessment.
We may suspend or terminate access where we reasonably believe these rules have been broken.
10. Intellectual property
The JTI methodology, the questionnaire items, the Reports, the AI prompt designs, the software, and all related content are owned by or licensed to Optimas. All rights not expressly granted are reserved.
Subject to these Terms, you receive a limited, non-exclusive, non-transferable, revocable licence to use the Service and the Reports for your own internal purposes (in the case of Practitioners, including delivery of services to your clients).
You retain rights in any free-text content you submit (notes, reflections, chat messages). You grant us a worldwide, royalty-free licence to use that content as necessary to operate the Service for you, including by transmitting it to AI providers as described in the Privacy Policy. We will not use your free-text content for marketing or to train our own models.
11. Pricing, billing and refunds
Practitioners purchase Assessment credits and other products through the Service or through their Distributor. Prices are shown in the applicable currency and are exclusive of VAT unless stated otherwise.
Credits are non-refundable once consumed by an Assessment. Unused credits may be refunded on written request to support@onlinejti.com within 14 days of purchase, in line with applicable consumer-protection rules.
Where a payment fails or is reversed, we may suspend the affected services until payment is settled.
Respondents are not billed for the Service.
12. Service availability
We use commercially reasonable efforts to keep the Service available, but we do not guarantee uninterrupted access. The Service may be unavailable from time to time for maintenance, upgrades, or reasons outside our control.
We may modify, suspend or discontinue parts of the Service. Where this materially affects paid features we will use reasonable efforts to give advance notice.
13. Suspension and termination
You may stop using the Service and close your account at any time.
We may suspend or terminate your account where:
- you breach these Terms in a material or repeated way;
- we are required to do so by law, by a court order, or by a competent authority;
- your Practitioner certification is withdrawn or expires;
- we reasonably suspect fraud, misuse, or risk to other users;
- an account remains inactive for an extended period and is anonymised under our retention rules.
On termination, your right to use the Service ends. The treatment of your personal data after termination is described in the Privacy Policy.
14. Disclaimers and limitation of liability
Except for the limited warranties expressly set out in these Terms, the Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all other warranties, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, our total aggregate liability to you under these Terms in any 12-month period is limited to the amount you paid to us for the Service in that period. For Respondents who do not pay for the Service, our total aggregate liability is limited to one hundred Norwegian Kroner (NOK 100).
We are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, business, goodwill or data.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded under mandatory law (including Norwegian consumer-protection rules where they apply).
15. Changes to these Terms
We may amend these Terms by posting an updated version at this URL with a new version reference. Material changes are signalled inside the application by a prompt to re-accept the Terms before your next use of the Service.
If you do not agree to an updated version, you must stop using the Service. Your prior use is governed by the version of the Terms in effect at that time.
16. Governing law and disputes
These Terms and any non-contractual obligations arising out of or in connection with them are governed by Norwegian law, without regard to its conflict-of-law principles.
The courts of Norway have exclusive jurisdiction, with Oslo District Court (Oslo tingrett) as the agreed venue. This does not deprive you of any protection afforded by the mandatory consumer rules of the country in which you habitually reside.
